CJ Gideon wins motion to disqualify counsel

On June 14, 2018, C. J. Gideon, Jr. argued a petition for Declaratory Order before the Board of Examiners in Psychology for the state of Tennessee, in an effort to obtain a contested case hearing before the Board leading to acceptance of KY PRN as an alternative to TCAF as an advocacy and oversight agency. Counsel for the state simultaneously advised the Board on the law, and then advocated denial of the Petition. Following the motion to disqualify counsel for the Department of Health filed August 2, 2018, and subsequent briefing, by Order entered August 18, 2018, Administrative Law Judge Steve Darnell granted the motion and disqualified counsel for the state.
