Chris Vrettos files amicus brief at the Tennessee Supreme Court

Chris Vrettos filed an amicus curiae brief on behalf of the Tennessee Defense Lawyers Association in Martin v. Rolling Hills Hospital, LLC, et al. The Martin case is on appeal before the Supreme Court of Tennessee following the Court of Appeals’ reversal of a trial court order dismissing the case for deficiencies in the HIPAA authorization provided with pre-suit notice. Mr. Vrettos addressed two issues on which the Supreme Court solicited briefing: (1) the proper role of prejudice in pre-suit “substantial compliance” analysis; and (2) the proper evidentiary burden for demonstrating prejudice, inclusive of whether the Court should adopt a rebuttable presumption of prejudice where the pre-suit notice is not accompanied by a facially compliant HIPAA authorization. Mr. Vrettos currently serves as the co-chair of the Tennessee Defense Lawyers Association’s Professional Negligence and Health Care Section.
