C.J. Gideon, Jr., Blake Carter, and Brandon Huber obtain involuntary dismissal in the Tennessee Court of Appeals

C.J. Gideon, Jr., Blake Carter, and Brandon Huber obtained an order of involuntary dismissal on behalf of a general surgeon and Jackson, TN-based hospital in a case involving complex surgical and oncology issues. After Defendants obtained summary judgment, Plaintiffs appealed to the Tennessee Court of Appeals. Defendants filed a Motion to Dismiss the Plaintiffs’ appeal, arguing that the Court of Appeals lacked jurisdiction to hear the appeal. The Court of Appeals, after finding it lacked jurisdiction because Plaintiffs had not timely filed their notice of appeal within the time provided under Tenn. R. App. P. 4, granted Defendants’ Motion to Dismiss. The order addresses Tenn. R. App. P. 4’s strict requirement that a notice of appeal in civil cases be filed within thirty (30) days from a trial court’s entry of final judgment. The order can be found here.
