The Eighth Circuit Court granted GETC’s Motion to Compel Genetic Testing based on evidence presented and arguments from counsel on May 31, 2024.  In a pending case involving claims of negligence during labor and delivery, the defense requested genetic testing, which was supported by an affidavit from an expert geneticist.  The plaintiff refused to consent to the testing.  The court determined that genetic testing fell within the purview of an independent medical exam and ordered the testing in a written opinion believed to be one of the most thorough in Tennessee addressing this emerging issue.
